Provided that where the r:omplainant is a state functionary and the offence has not been
committed against a private person, the Juvenile Justice Committee may dispose of the case
through diversion with consent o 'the concemed public prosecutor.
(5)
For the purposes
of
diversion,
all offences either minor or major shall
be
compoundable.
(6)
Diversion shall be exercised in the prescribed manner in cases-
(a)
where
(b)
where a jrrvenile is accused of commission of major offences and the age
a
jrrvenile is accused of commission of minor offences; and
of the jurenile is not more than sixteen years at the time of commission
of offenct:.

Juvenile Justice Committee.-

(l)
On commencement of this Act but not later
in consultation with the concemed
Sessions Judge shall
establish the Juvenile Justice Colnmittee for each sessions division.
(2)
The Juvenile Jusr.ice Committee shall consist of four members with following
composition, namely:(a)
serving J:dicial Magistrate with powers under section 30 of the Code,
who shall also head the Committee;
(b)
district prrblic prosecutor;
(c)
member
(d)
serving p robation officer or social welfare offioer not below the rank
cf
loca1 Bar having at least seven years standing at the Bar,
appointecl by the concemed Sessions Judge for period of two years;
of
an officer in BPS-17.
(3)
The place of sitting of the .luvenile Justice Committee may preferahly be in the
same premises where the Juvenile Court holds sining.
(4)
The Juvenile Justrce Committee shall perform following lirnclions, narnely:-
