1[118. Powers of district court‑martial. A district court‑martial shall have power to try any person
subject to this Act, except an officer, junior commissioned officer or warrant officer, for any offence
made punishable therein, and to pass any sentence authorised by this Act other than a sentence of
stoning of death, death, amputation of hand, foot or both, imprisonment for a term exceeding two
years or whipping exceeding forty stripes.].
119. Prohibition of second trial. When any person subject to this Act has been acquitted or
convicted of an offence by a Court‑martial or by a Criminal Court, or has been dealt with under
section 82 or section 86, he shall not be liable to be tried again for the same offence by a
Court‑martial 2[or by a Criminal Court] or be dealt with in respect of it under the said sections 3[:]
3[Provided that, where the finding or sentence of the Courtmartial has not been confirmed by
the confirming authority being illegal or unjust, or where proceedings has been annulled under section
161, the confirming authority or the authority competent under section 161, as the case may be, may
order a retrial of such person :
Provided further that, where retrial is necessitated under the provisions of any Islamic law, the
confirming authority or, as the case may be, the Court of Appeals shall order a retrial.]
120. Period of limitation for trial.___(1) Except as provided by sub section (2), no trial by
Court‑martial of any person subject to this Act for any offence shall be commenced after the
expiration of a period of three years from the date of such offence.
(2) The provisions of subsections (1) shall not apply to a trial for an offence of desertion or
