Porver to make rules.- The Govemment may, by notification in the offrcial
Gazette. make rules for carrying out the purposes of this Act.
25.
Repeal.- The Juvenile Justice System Ordinance, 2000
(XX[ of2000)
is hereby
repealed.
STATEMENT OF OBJECTS AND REASONS
Article 35 of the' Constitution of Islamic Republic of Pakistan provides that the State shall
protect the child. Article 25(3) also empowers the State to make special provisions for protection
ofchildren. Furthermore, Pakistan is signatory to the UN Convention on the Rights of Child and
is under obligation to take special measures for the protection and rehabilitation ofthejuveniles.

The object of this Bill is to modi$ and amend the laws relating to criminal justice system
for juveniles by providing special focus on disposal of cases through diversion and socialreintegration of the juvenile offenders.

The Hon'ble Lahore High Court, Lahore in its judgment reported as PLD 2005 Lahore l5
while striking down the prevalent the Juvenile Justice System Ordinance,2000, observed that
Parliament may enact a fresh law after attending to all the infirmities of Juvenile Justice System
Ordinance,2000.

It is firther
expedient to provide special procedure for judicial proceedings as well as
provisions for diversion and social reintegration of children who alleged to have cornmitted an
offence and come in conflict u'ith law without resorting to formal judicial proceedings and
disposal of matters in the best interest of children and for their rehabilitation through processes
provided, and institutions and bodies established.

The Bill seeks to achieve the above mentioned objectives
